- I argued the mother was trying to erase me from my daughter's live ...
My CLOSING STATEMENT :
- I brought to the courts attention my oldest daughter was having trouble, that the mother had been told lies about receiving stitches while under my care, and the mother stated that 'she (my oldest) says what ever she wants to whom ever she wants' , I continue telling the judge that everyone let her (my oldest daughter) down in this case - that she (my oldest) slipped out of her father's care who offered her 'structure and rules' into a world of ' no rules ' her mother offered her - and now her mother could not change that path , and that although I did not have my daughter neither does the mother.
- I brought to the courts attention that my middle daughters report card for march 2011 shows she was struggling in several topics , including home reading - which says she is to read 30+ pages a night , and that NO ONE WAS SIGNING THE CHILDS DAILY AGENDA THAT THEY WERE WORKING WITH THE CHILD or reading the agenda.
- I brought to the courts attention that the children were enrolled in a public school now, that they indicated they missed their catholic school - that my youngest daughter in particular missed her friends and teachers , and they both missed especially bible stories and that their grandmother ( my mother ) had bought them a easter book and we read it over and over together cause they loved the stories.
- I brought to the courts attention that I have not lied to the court, and even in the face of what appears to be CLERC's therapist brain washing my children that I would not hold them hostage and let them go.
- I brought to the courts attention that on the weekend of March 25th my children were verbally fightening alot, and that they were calling each other names such as 'M*THER F*CKING BITCH' , and I asked them were they heard such things and the child said at home, their oldest sister (12yrs old) says it all the time.
- I brought to the courts attention that my youngest daughter almost 8 had started wetting the bed at her mothers which she had not done since she was 5 - that she was having trouble adjusting for reasons previously stated.
- I ask to consider the court gave the mother another chance, and that I also gave her a chance, and that she's out of chances.
- I asked the court to return the youngest two daughters to their father , that their school who has a caped (max) #of students could re-enroll them as early as right NOW.
THE MOTHERS TURN :
The mother said that her nor the children are interested or want to talk to the CLERC lawyer, but that she would allow the children to speak with her anytime ...
The mother said just this week the children came to her and said "they hate religion" ...
( OK PEOPLE, at this point I think the mother is just digging a hole for herself , this is too good to make up, the children 'hate' religion ... I am almost thinking I have a chance at this point ... )
The mother says the children rarely bring home their school agenda else she would sign it ...
The mother says she is being ambushed today ... and goes on and on - NOT about the issues I raised above but mostly how I am an @ss and how she was separated from her children while they lived with me.
The ABUSE is side stepped - never addressed ... not denied or confirmed .. just left hanging in mid air ...
CLERC ( children's lawyer ) closing statement :
CLERC's statement was short - the Judge was nodding before the sentence came out of the lawyer's mouth , that she is no longer needed on this file and/or wanted ... and wanted to step down as the children's representive.
If you look on CLERC Calgarys website you'll see under their mission that the 'United Nations Convetion on the Rights of the Child will guide and underpin their work',
Guess CLERC had a different UN mission ... not save the children .. save MOTHER , if MOTHER gets in trouble again .... RUN !!
JUDGE's DECISION :
CLERC lawyer dismissed , mom and dad of these children - work it out.
COURT ROOM getting crazy :
I remind the Judge CLERC represents the children, there are abuse allegations here, that the children are expressing their wishes ...
The mother continues interrupting ( she was piping up during my times to speak earlier ) , she is saying things like I need mental therapy etc , the mothers arms are flying around and she crosses the isle between us ... close enough to hit me.
I believe at this time the police were signaled , CLERC lawyer exits quickly ...
I direct my attention to the judge while the mother is coming loose , I ask the Judge where's the integrity in this court , the mother has lied before - she has a abuse history - the children are contacting me telling me they are scared ....
The JUDGE IN A NUT SHELL in my opinion COULD GIVE A SH1T ... CLERC's done their job of brain washing and wants out , and the Judge is here to make sure mom is untouchable ....
I (perhaps foolishly) tell the Judge my lawyer # 4 told me this court would discriminate against me. This seam's to unnerve the Judge who finally speaks from her superior stance enjoying the gong show before her ... she wants to know which lawyer told me the court would discriminate ...
The POLICE enter and the mother and her latest boyfriend exit seemingly unobstructed - they are NOT detained or questioned , though the mother crossed the isle during the session which i think triggered the alarm I am however detained - cause I am a man? - I am told to sit , my water container is examined in case it might be used as a weapon ... my name - DOB etc are taken, I asked if I am being charged with something ?
- the judge has long since fled from the room ...
Today was just another devastating day for this father. No matter what I do , no matter how I try to help my children it seems I am stone walled and frozen in a holding pattern while they protect the mother.
Looking at what happened today i think back about a year , the mother simply made a ridicules accusation I was interfering with the children's email and it was put in a court order along with clauses like enforceable by a peace officer. The current access I have to my children is not even enforceable by a peace office, if the mother denies me access after the 90 minute drive I have to petition the judge.
How do fathers continue on in the face of such adversity, today I believe the mother was given a pat on the back by the Judge, give him hell ...
February 2013 - my oldest daughter runs away from her mother whom taught her to resent her father , i am powerless to help her for now , lawyers say in the 'best interests of the child' - i dont think so.
